The full text of the DMCA is available on the U.S. Copyright Office website.
Who to Contact About Copyright
Send all copyright notices to our Designated Copyright Agent:
The Equipment Manuals, Attn: Copyright Agent
15 Campus Boulevard, Newtown Square, Pennsylvania 19073, US
Email: info@theequipmentmanuals.com
Please use the subject line "Copyright Notice" so your message reaches the right person quickly.
How to Report a Copyright Infringement
You can send a notice if you own the copyright, or if you're authorized to act for the owner or under an exclusive right. For us to act on it, the law requires your notice to include all of the following:
- The copyrighted work you believe has been infringed. If several works are involved, a representative list is fine.
- The material on our Site you believe is infringing and want removed. Give the exact page URL(s) or other details we need to find it.
- Your contact details: name, company (if any), mailing address, phone number and email address.
- A good-faith statement that you believe the use of the material is not authorized by the copyright owner, its agent or the law.
- An accuracy statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
- Your signature, physical or electronic. A typed full name works as an electronic signature.
If anything is missing, we'll ask you for it. Please reply promptly. We may not be able to process an incomplete notice.
Please Make Sure Your Notice Is Accurate
Only send a notice if you're confident the material infringes your rights. Under Section 512(f) of the Copyright Act (17 U.S.C. § 512(f)), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, can be held liable for damages.
If you're not sure whether your notice meets the legal requirements, it's worth speaking to a lawyer. The requirements for notices are in 17 U.S.C. § 512(c)(3), and the rules for counter-notices are in 17 U.S.C. § 512(g)(3).
What Happens After We Receive Your Notice
We review every complete notice promptly. Where appropriate, we remove the material or disable access to it. We may pass a copy of the notice, including your contact details, to the person who uploaded or provided the material. We may also let affected customers know that the material has been removed.
How to File a DMCA Counter-Notice
If you believe material was removed because of a mistake or misidentification, you can send a counter-notice to our Copyright Agent at the address above. It must include:
- A description of the material that was removed and where it appeared on the Site before removal.
- A statement, under penalty of perjury, that you believe in good faith the material was removed or disabled because of a mistake or misidentification.
- Your name, address and phone number.
- Consent to jurisdiction: a statement that you consent to the jurisdiction of the federal district court for the district where you live (or, if you live outside the United States, any judicial district where The Equipment Manuals may be found), and that you will accept service of process from the person who sent the original notice.
- Your signature, physical or electronic.
When we receive a valid counter-notice, we may forward it to the person who sent the original notice. If they don't tell us they've filed a court action, we may restore the material within 10 to 14 business days.
Repeat Infringers
Where appropriate, we may close the accounts of users who repeatedly infringe copyright.
